Birth tourism has been a legal loophole ever since the ratification of the 14th. This is because the pregnant woman was in the U.S. legally and under the jurisdiction thereof and her child was considered a “person”. But...the US, just like all sovereign nations, absolutely can deny entry to ANY non-citizen. Anchor babies have NEVER been legal.
