Oklahoma ABLE Commission - Home

To whom it may concern, With the passage of HB1111 in the Oklahoma House of Representatives yesterday (Monday Feb. 17, 2020), I was wondering how soon we can expect a legal challenge from the ABLE commission [ https://www.ok.gov/able/index.html ] (or other applicable organizations such as the Oklahoma Restaurant Association or Oklahoma Hotel & Lodging Association) to this piece of legislation that not only violates the single subject rule of the Oklahoma Constitution in seeking to amend firearms law (Title 21) and alcohol law (Title 37A), but also seeks to redefine Oklahoma Alcohol Laws without updating the pertinent section(s) of Title 37A or taking into account the diversity of licenses and types of establishments licensed to dispense alcohol in Oklahoma? I am specifically referring to Section 6-114 [ http://www.oscn.net/applications/oscn/DeliverDocument.asp?CiteID=480375&fbclid=IwAR1hfae4JOsQPx3GNtpHHBls_JvanbZI6cAC2KflHh_2_XFbYNdT1gGkfUg ] which establishes a standard of at least 35% food sales for an establishment licensed to dispense alcohol that has a full kitchen and serves food from a full menu in order for its primary purpose to be other than alcohol sales. The Texas-like 51% provision of HB1111 (as amended on the House floor) is in contravention of Title 37A. The Bill itself also does not take into consideration the ABLE Commission’s ultimate authority to designate the primary purpose of any establishment licensed to dispense alcohol in Oklahoma.
